Terms of Use
These terms are the agreement between you and Mishmapps LLC (“Mishmapps,” “we,” “us”) covering your use of the Minuet app. By downloading or using Minuet, you accept them. If you do not accept them, please delete the app.
If you are under the age of majority where you live, you should read these terms with a parent, guardian, or teacher.
1. What Minuet is, and what these terms cover
Minuet is a metronome and chromatic tuner for iPhone and iPad, published by Mishmapps. It provides tempo and pitch tools for practice, along with a private, on-device record of your own practice sessions and any takes you record. In these terms, "Minuet" and "the app" mean the software, its artwork and sounds, any skins you unlock within it, and any updates we release for it.
Minuet is a practice aid. It is not a lesson, a course, a teacher, or a measuring instrument, and §4 below explains the limits of what it can tell you.
These terms cover your use of the app. The playminuet.com website is a static informational page where these documents are published; browsing it requires no agreement and involves no data collection. These terms do not cover Apple's App Store, which has its own terms, or any app or service you send content to using Minuet's Share feature.
2. Your licence
We grant you a personal, non-transferable, non-exclusive licence to use Minuet on Apple devices you own or control, in line with Apple's App Store Terms of Service. This is a licence to use the app, not a sale of it. We keep all rights not expressly granted here.
You agree not to:
- Copy, sell, rent, sublicense, or redistribute the app
- Reverse engineer, decompile, or attempt to extract the source code, except where law expressly permits it
- Circumvent, disable, or tamper with purchase verification, or unlock paid content by any means other than purchasing it
- Use the app in any way that breaks the law where you are
3. Skins and purchases
Minuet is free. Skins are optional purchases that change how the app looks. They are cosmetic only.
Nothing behind the paywall affects function. Every metronome, tuner, and practice feature works identically regardless of what you have bought. Buying a skin changes the appearance of Minuet and nothing else.
How purchases work
All purchases are made through Apple's In-App Purchase system. Apple is the seller of record, and your purchase is also subject to Apple's Media Services Terms and Conditions.
Skins are non-consumable: a one-time purchase, not a subscription, with no recurring charge. Once bought, a skin is permanently unlocked for the Apple Account that bought it.
Prices are set per storefront and shown to you by Apple before you confirm. They include any tax Apple is required to collect. Prices may differ between countries and may change over time. Currency conversion, if any, is handled by Apple and your payment provider.
What a skin is, and is not
A skin is a limited licence to display artwork inside Minuet. It is not property, and you do not own it.
Skins have no monetary value outside the app. They cannot be exchanged for money, transferred, gifted, sold, traded, or moved between Apple Accounts, and there is no mechanism by which we could do any of those things. Attempting to sell or trade access to purchased content is a breach of these terms.
Your Apple Account
Purchases are tied to the Apple Account used to buy them, not to a device.
You can reinstall Minuet or move to a new iPhone or iPad and recover your skins with Restore Purchases, as long as you sign in with the same Apple Account. If you lose access to that account, we cannot transfer, re-issue, or reinstate the purchases attached to it — we have no visibility into Apple Accounts and no ability to move purchases between them. That recovery is between you and Apple.
Skins support Family Sharing: buy a skin once and everyone in your Apple Family group can use it. Sharing is managed through Apple's Family Sharing settings, not by us.
If you are under 18
If you are a student using a device paid for by a parent, guardian, or school, you need their permission before buying anything. By making a purchase you confirm you have it.
We would encourage families to turn on Ask to Buy in Apple's Screen Time settings, which requires a parent to approve each purchase before it goes through.
Refunds
Refunds are handled by Apple, not by us. We do not process payments, cannot see your transaction, and have no ability to issue a refund.
Requests go to Apple at https://reportaproblem.apple.com, and Apple's decision is final. If you are a consumer in the EU or UK, your statutory rights in relation to digital content — including any right of withdrawal — apply against Apple as the seller, and nothing in these terms limits them.
If a skin is genuinely broken, tell us at support@playminuet.com. We will fix it, and we would rather hear about it than have you find out through a refund request.
Availability and changes
We may add skins, retire skins from sale, run promotions, or change prices at any time. A price change never applies retroactively to something you have already bought, and a promotional price does not entitle earlier buyers to a partial refund.
If a skin is withdrawn from sale, everyone who already bought it keeps it. We will make reasonable efforts to keep purchased skins working across future versions of Minuet and future releases of iOS.
We cannot guarantee this absolutely. A skin might have to be altered or, in rare cases, withdrawn — for example if a licence underlying its artwork or typography ends, or if an iOS change makes it impossible to render. If we ever have to withdraw a skin you paid for, we will say so in the release notes and explain why. We will also honour a refund request to Apple for it if you make one, though the decision remains Apple's.
4. Accuracy — please read
Minuet is a practice tool. It is not a calibration instrument.
Tempo and pitch measurement depend on your device's hardware, its microphone, background noise, the room you are in, and what iOS is doing at that moment. Timing may drift under heavy system load. Pitch readings may be affected by ambient sound, poor microphone placement, or the acoustic properties of your instrument.
Do not rely on Minuet where precision genuinely matters — professional instrument setup, intonation work on an instrument you cannot easily re-adjust, recording sessions, examinations, or any situation with a cost attached to being wrong. Verify against a dedicated instrument.
The suggested working tempo Minuet derives from your practice is a convenience, not musical instruction. It does not replace a teacher.
5. Hearing and safety
Minuet produces sound, including sustained drone tones and click tracks often used with headphones for long stretches.
Set a comfortable volume before you start, and do not raise it to overcome a noisy room. Prolonged exposure to loud audio can permanently damage your hearing. If you are practising with headphones, take breaks.
Do not use Minuet while driving, cycling, or doing anything else that needs your full attention.
6. Your content
Pieces you create, the notes you write in them, the recordings you make, and your practice record are yours. They stay on your device and we claim no rights over them.
If you use Minuet's Share feature, your device's own share sheet sends what you have selected to whichever app or person you choose. We do not host, store, or see that content, and once it leaves your device it is governed by whatever service you sent it to.
You are responsible for anything you share, including making sure you have the right to share it.
7. Our content
Minuet — its code, design, interface, artwork, skins, sounds, the name "Minuet," the name "Mishmapps," and their associated marks — belongs to us or our licensors and is protected by copyright and trade mark law.
You may take screenshots and video of Minuet for reviews, lessons, teaching materials, and social posts. You may not extract, redistribute, or reuse the app's artwork, skin assets, or audio as standalone material.
8. No warranty
Minuet is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, compatible with every device or future iOS release, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only as far as the law permits, and you may have rights that these terms cannot remove. Nothing here limits your statutory consumer rights.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, missed opportunities, or damage to hearing or equipment arising from misuse of the app contrary to the warnings above.
Our total liability for any claim relating to Minuet is limited to the greater of the amount you paid for in-app purchases in Minuet in the twelve months before the claim, or ten US dollars.
This clause does not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
10. About Apple
You and we both acknowledge:
- This agreement is between you and us. It is not with Apple, and Apple is not responsible for Minuet or its contents.
- Apple has no obligation to provide maintenance or support for Minuet.
- If Minuet fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Minuet.
- We, not Apple, are responsible for addressing any claim relating to Minuet, including product liability, failure to conform to legal requirements, and consumer protection claims.
- We, not Apple, are responsible for investigating and defending any third-party claim that Minuet infringes intellectual property rights.
- You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Changes and ending
We may change these terms. If we do, we will update the effective date and note it in the app's release notes. Continuing to use Minuet after that means you accept the change. If you do not, delete the app.
We may change or discontinue the app. Features may be added, altered, or removed between versions.
You may stop at any time by deleting Minuet. Your licence ends when you do. Sections 7 through 12 survive.
12. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Dallas County, Texas.
If you are a consumer resident in the EU, UK, or another jurisdiction whose law gives you the right to bring proceedings locally, nothing here removes that right.
If any provision is held unenforceable, the rest stays in force.
